PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 FEBRUARY 2019
Specific Outcome 05 also requires house site areas to be located at least 50m from any land within
a national park. The additional lot is located within 50m of the National Park and while a building
has already been constructed on the lot there is potential for ongoing edge effects.

4.2. Other Referrals
The application was forwarded to the following internal Council officers:
Coordinator Operational Works
Two external Hydrology Consultants
4.3. Public Notification

5. CONCLUSION & REASONS FOR DECISION
The applicant seeks to create 2 new residential detached house lots, one of which is nearly
completely inundated in a 1% AEP event.
It is proposed to raise the driveway to help offset flooding impacts on the surrounding properties
and to gain safe access to and from the site. However, it is considered the applicant has not
sufficiently demonstrated that there will be no offsite flooding impacts as a result of the proposal
and therefore has the potential to cause actionable nuisance and compromise the safety of people
and property.
The proposal is not consistent with The Noosa Plan’s Noosa Heads Locality Code and
Reconfiguring a Lot Code as the proposed lots, particularly lot 1, is not suitable for its intended use
given the overland drainage path that flows through the site. The proposed lots are not fully located
above the defined flood event level and are subject to flooding.
While a building has been built on lot 1, the creation of a separate lot will ultimately place more
people within a flood area putting people at risk particularly where future residents are unaware of
the drainage overland flow path. Modification will also be required to the existing buildings to
ensure they meet the requirements for one detached house and are only ever used as 1 detached
house into the future.
