RECOMMENDATION
That Council note the report by the Manager Development Assessment to the Planning &
Environment Committee Meeting dated 11 June 2019 regarding Planning & Environment Court
Appeal No 2760 of 2018 and agree to settle the appeal generally in accordance with the
amended conditions set out in Attachment 3.
REPORT
On 15 March 2018, Council decided to approve an application for Operational Works for signage
for the Noosa Village Shopping Centre, subject to a number of detailed conditions.
The applicant subsequently made representations to the Decision Notice (Attachment 1) seeking
approval for:
All 3 pylon signs to be illuminated (the approval limited this signage to only 2 pylon signs
being illuminated, with the third not permitted to be illuminated); and
Retention of the existing illuminated Woolworths sign and Reject Shop sign.
On 19 July 2018, Council at its Ordinary Meeting resolved to refuse to change conditions 1, 2, 8
& 9 of a Development Permit for Operational Works for signage for the Noosa Village Shopping
Centre for the following reasons:
1. The proposed changes will result in additional signage and illumination of signage contrary
to the Noosa Plan’s Advertising Devices Code.
2. The proposed changes will detract from the amenity and desired character of the area and
contribute to visual clutter.
3. The proposed changes are not legitimately necessary to provide directions and/or identify
the businesses location to residents and visitors to the area.
As a result of Council’s decision to refuse the representations, the applicant lodged an appeal
with the Planning & Environment Court. The appeal notice detailed that the appellant sought that
the court approve the illumination of the third pylon sign and signage for Woolworths and the
Reject shop fronting Gibson Road.
