PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 JUNE 2019
In accordance with the Planning & Environment Court’s directions, 2 mediation meetings were
attended by Council officers and the appellant with the court registrar. At the mediation, the
appellant made submissions to a number of the conditions of the Operational Works approval
including the disputed conditions 1, 2, 8 & 9 and additional matters not currently identified in the
appeal notice or requested as part of the representations to the Decision Notice. The appellant
sought:
all 3 pylon signs to be illuminated, referred to as S01, S02 and S03 on the proposal plans
(Attachment 2).
approval of a sign for Woolworths and the Reject Shop of 18.6m2 fronting Gibson Road
referred to as S09 on the proposal plans.
an increase in the sign face area of the approved sign for Woolworths/BWS fronting the
internal car park referred to as S05 on the approved plans from 10m2 to 16.2m2.
Notably this would have required the appellant to amend their appeal notice, which is permissible
by the Planning & Environment Court.
Illuminated Pylon Signs
At mediation, the appellant proposed that the illumination of the third pylon sign served a relevant
purpose by alerting visitors that the shopping centre was open, with the lighting turned off at
closure of the centre. The appellant advised in this regard, that this sign when lit was visible to
motorists at night at the Mary St/Gibson Road roundabout when travelling from Weyba Road and
clearly identified for visitors whether the centre was open or closed. The appellant also pointed
out that the site has a significant road frontage to Gibson Road measuring approximately 230m in
length
It is considered that there is some merit in the appellant’s submission, with the existing
illuminated sign clearly visible at night at the Mary St/Gibson Road roundabout and the site
having an extensive road frontage. Review of the former local law signage register also shows
that 3 illuminated pylon signs were previously approved for the shopping centre. For these
reasons, officers agreed at mediation to recommend to Council that the 3 pylon signs be
permitted to be illuminated.
Woolworths & Reject Shop
On review of the appeal, officers noted that the approved signage for the shopping centre
included no signage for the building fronting Gibson Road, despite the building being 135m long,
with the signage approved for this frontage limited to 2 pylon signs, a low level entry sign in the
car park and centre logo signage. While Council had approved a total of approximately 80m 2 of
signage for the shopping centre the current limit on this frontage appeared overly restrictive and
on advice from Council’s solicitor it was considered reasonable to permit some signage on the
building for the shopping centre tenants. Again, review of the former local law signage register
showed that one illuminated Woolworths sign had been previously approved for this frontage,
although none for the Reject Shop.
For these reasons officers agreed at mediation to recommend to Council that a combined sign for
Woolworths and Reject Shop not exceeding the total sign face area of the existing Woolworths
and Reject Shop signs of 9.262m2 be approved.
Woolworths/BWS Sign
At mediation officers did not agree to any increase in the approved Woolworths/BWS sign from
10m2 to 16.2m2.
On this basis, the appellant also agreed at mediation to settle the appeal.
