PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 JUNE 2019
The strategic framework states the community vision for Noosa Shire and envisages industrial
development primarily located in the Noosaville and Cooroy industrial estates. The subject
application does not sit within either the Noosaville Industrial Estate or the Cooroy Industrial
Estate. The dry cleaning and surfboard manufacturing uses were established prior to the Noosa
Plan gazettal, therefore existing use rights exist for those uses alone. The scale and intensity of
the existing uses is minor, limited in capacity due to the size of the building and unlikely to
negatively impact on Noosa Shire’s Industry zoned areas.
By virtue of the fact that the proposed uses are inconsistent with the Attached Housing Zone, the
proposal does not comply with the Noosaville Locality Code. While the application to
accommodate undefined industrial businesses Low Impact Industry and Service Industry, and
Industrial Businesses Type 1 is incompatible with the Specific Outcomes of the Noosaville
Locality Code, to an extent, the uses are acceptable due to the existing use rights on the site
provided the proposed uses do not result in any new or increased impacts for neighbouring
properties. It should be noted, in this instance, that a dry cleaning and surfboard manufacturer
uses have operated on site for a number of years without any known detrimental effects on the
surrounding residential properties.
The proposal does not include any physical changes to the existing building or premises. The
current configuration of the building and its extents have been previously approved and remain
respectful of the environment in which it sits. The existing building is oriented away from the
adjacent residential uses and an existing barrier fence is installed along the affected boundaries
as shown above in Figure 4 in Section 2.3 of this report.
The former surfboard manufacturing use was conducted wholly within the building and therefore
it is considered that there are no use rights for the rear courtyard adjacent to the residential use.
This rear courtyard is not accessible by vehicles and will therefore be limited in its operational
capacity and unlikely to cause any adverse impacts on the neighbouring residential use.
Existing landscaping on site is not proposed to be altered and the significant area of landscaping
on the Gibson Road frontage effectively screens the premises from residential premises opposite
as does the vegetation on and around the Eumundi Noosa Road roundabout at Gibson Road.
Business Uses Code
The Business Uses Code seeks to ensure development is conducted in an ecologically
responsible manner, minimises impacts on surrounding uses and receiving environments
including pollutants, noise, dust odour, light and vibration. The Code also seeks that activities are
located on sites appropriately sized for the scale of the industry or service and impacts on visual
amenity are minimised. In this instance, two industrial uses have been operating from the site
historically without any adverse amenity impacts on surrounding land uses. Appropriate
conditions limiting uses of the site to those compatible with sensitive land uses would mitigate
any adverse impacts on the surrounding area.
Carparking
The car parking provision on site consists of 6 off street car spaces plus 2 cars accommodated in
the drive-through forecourt for pick up and drop off of the dry cleaners. There is the potential for
an additional 1 car parking space that has not been marked on site. A total of 9 spaces being
available on site.
The Driveways and Carparking Code requires, for industrial development, 1 space per 30m² up
to 150m², and 1 space per 50m² up to 500m² and 1 space per 100m² thereafter of use area. The
use area of the building is 688m² which triggers 14 spaces.
The site has 8 car spaces plus 1 unmarked car space, leaving the development 5 car spaces
deficient. The development’s on-site car parking has not changed since the original approval and
was deemed sufficient at the time for the dry cleaner and a surf board manufacturer. Under The
Noosa Plan a dry cleaner and a surfboard manufacturer are considered an Industrial business
type 2 and are currently or have operated for an extended period on site without any car parking
issues.
