PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 JUNE 2019
5. Conclusion and Reasons for Decision
Existing use rights apply to the dry cleaning service and surfboard manufacturing operation that
were in effect on the day fire destroyed the original building. The applicant seeks to expand the
list of potential uses that may lawfully establish on the site given the limited opportunities
available at the present time. The current zoning of the site results in any other industrial or
business type use wishing to establish on the site to be inconsistent and subject to an impact
assessment application.
The applicant proposes that Service Industry, Warehouse and Low Impact Industry Uses have
the capacity to expand the business opportunities on the site without creating undue negative
impact on adjacent uses in the surrounding area. While the draft planning scheme may describe
these uses with more detail than The Noosa Plan, Low Impact industrial uses still have the
potential for incompatible affects, given the location of adjoining residential uses.
With careful selection of appropriate and compatible uses, the scale of the operations on site are
unlikely to create any significant amenity issues. Extending the range of uses that may be
established at the premises does not pose a significant threat to the viability of existing identified
industrial precincts provided that future permitted uses are also compatible with the surrounding
uses. It is considered that appropriate conditions could address the issues identified to mitigate
the effect of incompatible use types. The application is therefore recommended for approval
subject to conditions.
Find the following sufficient grounds to justify the decision despite the conflict with the Planning
Scheme:
1. Certain small scale industrial businesses are unlikely to adversely impact on the
surrounding residential uses and would be generally comparable with the site’s existing use
rights.
