PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 JUNE 2019 It is proposed to provide 8 carparking spaces for visitors, plus 2 carparking spaces in tandem for staff, plus 1 disabled carpark, and 4 scooter spaces. A Coaster bus (12 seats) will also operate from the site for customers for occasional transfers and associated tours of the Brewery. A Pantech truck (6m x 2.4m) will undertake deliveries which is to be parked in the covered loading area at night. It is intended that the Coaster bus will utilise the loading area when attending the site during normal business hours for Brewery tours, which is to be managed to not clash with onsite deliveries. The Brew Café will also be attended by external brew tours. Operating hours are proposed to be 7am to 4pm Monday to Friday and 7am to 12 noon on Saturday for the industrial business (Brewery), and 5pm to 12pm Monday to Friday and 12 noon to 12 pm Saturday and Sunday for the entertainment and dining business (Brew Café). A business identification sign is proposed (about 4m² in area) which is to be placed on the front façade of the building facing Venture Drive. 2. SITE DETAILS 2.1. Background The application was lodged and properly made on 20 September 2018, with a Confirmation Notice issuing on 5 October 2018. The application as originally made was for a development permit for material change of use for Entertainment & Dining Business - Type 1 Food & Beverage (Brewery Tasting Area) and Industrial Business Type 2 Production, Alteration, Repackaging & Repairing (Brewery). An Information Request was issued by Council on 19 October 2018, raising a number of concerns about the operation of the business, in particular the use of the outdoor terrace area and seeking further justification about the lack of carparking being provided. On 26 February 2019, a request was received to change the application, which resulted in a second Confirmation Notice being issued on 7 March 2019. This proposal was for a development permit for material change of use for Entertainment & Dining Business - Type 3 Bar (Brew Café) and Industrial Business Type 2 Production, alteration, repackaging & repairing (Brewery), with the inclusion of part of the adjoining land at 134 Eumundi Noosa Road to provide additional carparking for the development. This necessitated a second Confirmation Notice and a second Information Request being issued on 14 March 2019. The applicant responded to this second Information Request on 18 March 2019. The applicant proposed to include land to the south (134 Eumundi Noosa Road) to provide additional parking by lease agreement; however, this arrangement was not acceptable because the tenure of the land could not be guaranteed in the long term. This is because the applicant was not able to provide an easement over the land in favour of 130 Eumundi Noosa Road or amalgamate the land. As a result, further discussions were held with the applicant to try and remedy the situation. The applicant subsequently changed the proposal which now applies over the subject land (130 Eumundi Noosa Road) only and it is agreed to operate the Brew Café outside normal business hours. It is suggested that this would alleviate the concerns about a lack of carparking being available on site for the uses. It was determined that pursuant to Schedule 1 of the Development Assessment Rules, the proposal is not substantially different and therefore the change is a ‘minor change’ pursuant to the definition under Schedule 2 of the Planning Act 2016. It is also noted that the applicant has commenced building works on site and a ‘stop work’ notice was issued. This included the construction of an outdoor terrace area beside the western boundary and the mezzanine level. Page 26 of 133
