PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 JUNE 2019
South East Queensland (SEQ) Regional Plan
The site is located within the Urban Footprint area of the SEQ Regional Plan. The proposal is
consistent with the regional policies of the SEQ Regional Plan.
Planning Regulation 2017
The following assessment benchmark from the Planning Regulation 2017 applies to the
application:
SEQ Development Area
The proposal is for urban activity within the Urban Footprint and is consistent with the
assessment benchmarks contained in the Planning Regulation 2017 for the SEQ Region.
3.3. Statutory Instruments – Planning Scheme
The subject site is located in the Cooroy and Lake Macdonald Locality and is zoned Attached
Housing. The proposed Retail Business Type 2 – Shop and Salon use is identified as an
inconsistent use in the zone and therefore the application is impact assessable.
Locality Provisions
Development sought in the Cooroy and Lake Macdonald Attached Housing zone is
predominantly attached housing and ancillary uses and structures associated with private
residences. The Overall Outcomes for the zone are stated as:
6.7.2 mm) For the Attached Housing Zone—residents and visitors are accommodated in
predominantly attached housing forms that—
i contribute to a high level of residential amenity, design quality and safety;
ii respect the scale and character of the streetscape and surrounding
development; and
iii are located within convenient access of employment centres, goods and
services, public transport and community facilities;
For new development the Code seeks the following overall outcome:
6.7.2 a) New uses and works are located, designed and managed to—
i be compatible with other uses and works;
ii maintain the safety of works;
iii avoid significant adverse impacts on the amenity enjoyed by users of other
premises, including acoustic and visual qualities; and
iv avoid significant adverse effects on the natural environment, including native
habitat removal, fragmentation and attrition;
The commercial component of the proposal does not comply with the Overall Outcomes for the
locality as it seeks to develop retail premises within land zoned for residential accommodation.
Comments on the development were sought from Council’s Strategic Planning team who
provided the following in this regard:
The previous use of a motel was consistent with the Attached Housing zone.
The proposed shopping centre use is inconsistent with the intensions of the Attached Housing
zone, however the location of the site, being on a major road within Cooroy and not adjoining any
other residential zones or residential land use, might be seen as a logical extension to the
business centre and the nature of the proposed business activities on this site is not out of
character in the immediate locality. In addition, it is reasonable to consider that any likely impacts
could be managed to a satisfactory level and not unreasonably impact on the surrounding
properties.
