It is premature at this stage to provide advice on the likely prospects of the appeal. There will be
costs associated with defending the appeal, particularly if the matter proceeds to trial.
Notably mediation was held with the applicant and the Court registrar on 2 April 2020 wherein
agreement in principle was generally reached on a number of minor matters around the wording of
a new Infrastructure Agreement that would enable Council to condition the dedication of land and
works external to the site required for the subdivision.
Since the mediation further material has been supplied by the appellant which officers, Council’s
external consultants and Council’s planning solicitor are currently reviewing.
