Figure 10 – Area of Relaxation
Accordingly, the development satisfies the intent of the Performance Outcome, and the proposed
front setback variations are considered appropriate in the context of the site and its approved built
form.
Side Boundary Setbacks
Due to the development being constructed within a cut and size constraints of the lot, retaining
walls are required along both side boundaries to facilitate a high density residential development.
The side boundary setbacks to the retaining walls are 800mm to the north-western boundary and
610mm to the south-eastern boundary. During the Information Request process, additional
landscaping details were sought to demonstrate that these setback areas could adequately
accommodate landscaping. The submitted plans confirm that suitable landscaping can be
established and maintained within these areas.
The fourth storey seeks a minor side boundary setback variation of 0.04 metres to both boundaries.
Importantly, this variation does not apply to the full extent of the storey or wall plane; rather, it is
limited to specific portions of the level. The extent of the variation is influenced by ground level at
this location of the building, noting that the site slopes towards the street. As a result, the
encroachment is localised and minor in nature, does not materially increase the building's
perceived bulk, and is considered appropriate in the context of the site and its topographical
constraints.
