Rear Boundary Setback
The application seeks a variation to the rear boundary setback for the third and fourth storeys. The
encroachment is limited to the building's stairwell and portions of the rear-most units and does not
represent a substantial extension of the building bulk towards the rear boundary.
The adjoining property’s dwelling is situated at the highest point of the site towards Nairana Rest
(approximately setback 18 metres from the common boundary) and is screened by existing
vegetation and the site's topography. As a result, the potential for adverse overlooking or privacy
impacts is limited. Notwithstanding this, to ensure an appropriate level of privacy is maintained
should adjoining properties redevelop in the future, a condition is proposed requiring a minimum
windowsill height of 1.7 metres for rear-facing windows to the affected units.
In this context, the rear setback variation is considered acceptable and remains consistent with the
objectives of the Performance Outcome.
