Ecological Assessment Report v2 NCES Ref: J000618 Lot 4 RP36729 – 111 Lake Weyba Drive, Noosaville 6 LEGISLATION AND OVERLAYS 6.1 Local Government 6.1.1 Noosa Council Planning Scheme 2006 – Biodiversity Overlay Table 2 describes the proposal’s compliance with the Specific Outcomes and associated Probable Solutions of the Code as detailed in Division 4, Table 13.2 of the Noosa Plan 2006. Overall, the proposed development has been determined to be compliant subject to Council acceptance of the proposed mitigation measures to compensate the northern extent of the new roadway within the Environmental Protection Area overlay and the potential clearing of vegetation for bushfire protection within the edge of the Environmental Protection Area overlay. Discounting impacts to vegetated areas subject to existing exempt clearing rights (10m along existing site boundaries for installation of fire management lines), the development directly impacts approximately 120m² of the Environmental Protection Overlay for the Lot 12 building envelope and APZ. A further 148m² of Environmental Protection Overlay in Lot 12 could be cleared to construct the recommended firebreak trail if the development is approved.. Therefore, the total development impact to the Environmental Protection Area overlay has been assessed as 268m². . © 2021 25
