SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 7 AUGUST 2018
Submission received Summary
Submission one Delighted if Council could stop people parking at Noosa Heads National
Park carpark. However, the carpark should not be physically closed /
locked all night.
A few short stay parks might be useful but having all parks limited to a
maximum of 2 hours would be inadequate for:
(a) A walk through the park via Hells Gate;
(b) Catching waves as they need to be shared with other surfers;
(c) A picnic followed by a walk for a family with children.
Submission two Overnight campers dominating car parks has become excessive and
limits the use by locals.
An overnight ban from 10:00pm to 4:00am could be effective.
Supporting a 4 hour daytime parking limit to prevent tourist camper vans
dominating the car parking for the entire day.
Submission three The decision to regulate parking in the National Park areas should be
applauded. A time limit of 3 to 4 hours would be appropriate to allow
time needed to walk, enjoy a surf or a swim.
Council should also consider limiting parking time for the streets around
Little Cove such as Alderly, Pandanus, Mitti and Kereela. Residents
could be supported by providing a vehicle specific exemption certificate.
Submission four The proposal for regulate the National Park carparks has a lot of merit.
Getting the time limits right will be key to ensuring the community is not
unfairly disadvantaged. To ensure the location is suitable for day-trips
and extended walks, any restriction to parking should be no less than 6
hours.
Agreement with the Department of Environment and Science (Parks and Forest)
The Department of Environment and Science has confirmed that there are no provisions in the
Nature Conservation Act 1992 preventing Noosa Shire Council’s local laws applying over the
National Park Carparks with respect to regulating off street parking.
The Department has formally consented to the relevant amendments by way of letter from Mr
Geoff Brittingham, Regional Director, South East Queensland.
Agreement with the Department of Transport and Main Roads
The Department of Transport and Main Roads has agreed to Council making the amending local
laws for all declared state controlled roads in the local government area, subject to the conditions
contained in the letter of the authorised delegate, Katherine Mackenzie, Corporate Counsel
(provided at Attachment 4).
In light of the requested conditions, the amending subordinate local law has been amended with
the inclusion, in section 8 (Amendment of sch 5 (State-controlled roads to which the local law
applies) of the following –
‘For the purposes of the Transport Operations (Road Use Management) Act 1995, section
66(5)(b), the chief executive’s written agreement is subject to the limitations specified in a
letter from the Department of Transport and Main Roads to the local government dated 19
June 2018’
Anti-competitive provisions
In consideration of the impacts identified in the Public Interest Test Report (Attachment 1), it is
recommended that each of the anti-competitive provisions identified in the public interest test
plan be retained in the amending local laws, because:
(a) The benefit of the anti-competitive provisions to the community as a whole outweighs the
costs; and
(b) The most appropriate way of achieving the objectives of the local laws is by restricting in
the way provided by the anti-competitive provisions.
