Ecological Assessment Report v1 NCES REF: J000542 Lot 9 on RP225312 – 100 Cooyar Street, Noosa Heads 6 LEGISLATION AND OVERLAYS 6.1 Local Government 6.1.1 Noosa Shire Council Planning Scheme 2020 – Biodiversity Overlay Table 2 describes the proposal’s compliance with the Performance Outcomes and associated Acceptable Outcomes of the Code as detailed in Part 8 Overlays, Table 8.2.2.3 of the Noosa Plan 2020. Overall, the proposed development has been determined to be compliant subject to Council’s acceptance of minor impacts to the mapped Area of Biodiversity Significance, MSES Environmental Values and Riparian Buffer Area overlay and the mitigation strategies proposed to mitigate these impacts. The Area of Biodiversity Significance mapping was constructed prior to the exempt clearing for bushfire protection being carried out and is no longer considered accurate with on-ground vegetation conditions (refer Plates 4 & 13 and VC01). Additionally, the Riparian Protection Area mapping has been overrepresented on the site and captures the existing building and modified area in the eastern site extent (refer Plate 14). This area exhibits limited woody vegetation and contained no macrophytes hence the mapping is not considered representative of onsite conditions. Finally, any vegetation clearing associated with the development would fall within the exempted development clearing footprint for a firebreak about the existing building (i.e., 1.5 times tallest adjacent tree height) and for routine maintenance of boundaries (i.e., 5m width in a KHA for a site measuring <5ha). Therefore, the development does not result in new impact to the extent of vegetation remaining on site which is regulated by the Biodiversity Overlay.
