SPECIAL MEETING AGENDA 12 SEPTEMBER 2019

a) Biodiversity, Riparian Buffers and Agricultural Land
Submissions were received in relation to the Area of Biodiversity Significance and the
Riparian Buffer Areas mapped as part of the Biodiversity, Waterways and Wetlands Overlay,
as well as the mapped Koala Habitat Areas and Ecological Linkages. Submissions related
to the extent of the native vegetation mapped as compared to actual vegetation on site and
the width of Riparian Buffers, with submitters mainly seeking a reduction in these areas.
Submissions received in relation to the Agricultural Land Overlay sought to have the mapped
area increased to reflect the cleared areas on the rural properties and the agriculture use of
those areas. In one case, a submitter requested the mapping to be removed.
In response to submissions, the biodiversity, riparian buffer and agricultural overlay maps
were reviewed by a qualified ecologist who considered available information for the individual
properties, and attended site visits where possible. The ecologist made recommendations
for minor mapping changes for some properties to correct mapping errors. Many of these
changes are not significant and do not require readvertising however will be incorporated
      into the final scheme.
The riparian buffers along various waterways have been also amended to ensure the buffer
widths do not reduce the area of protection currently afforded by the current Noosa Plan.
Consequently, for some waterways the riparian buffers have reverted back to the buffer
widths mapped in the Noosa Plan 2016. The mapping has been corrected for a number of
properties. This change is shown in attached maps – Attachment 4.

b) Coastal Erosion
Council received 29 submissions in relation to the Coastal Protection Overlay, as well as 127
form letters. The following changes have been made as a result of submissions:
 Clarify purpose and intent of the coastal protection overlay.
 Rename to Coastal Protection and Scenic Amenity Overlay.
 Remove local coastal building lines from the overlay maps. References to the State
government coastal building lines on the mapping and in the overlay code have been
            retained.
In addition to the above, submissions from Building certifiers raised some issues with the
triggers in the Tables of Development Assessment for the Bushfire, Landslide and Flood
Hazards Overlays which increased the levels of assessment from Accepted development
subject to requirements to code which was not intentional. These have been reviewed and
amended to reflect the required levels of assessment.

3.5 Other Significant Changes
a) The definition of small dwelling has been amended to be a dwelling that has no more than
100m² of gross floor area. Previously it was a maximum GFA of 90m².
b) The Medium Density Residential Zone code will be revised to correct an omission and include
the same setback requirements of 4.5m for the Noosa Waters revetment wall that appear in
the Low Density Residential Zone Code, so they apply to Sunseeker Close and Noosa
      Entrance complex.
c) To ensure development and land uses within an identified Resources Processing Area,
Separation Area, Transport Route or Transport Separation Area won’t impede the extraction
of resources, and to create consistency with the State Planning Policy, Table of Assessment
5.9.5 Extractive Resource Overly will be amended. The amendment will require code
assessment against the Overlay Code of extractive industry, reconfiguring a lot and a
material change of use (other than in an existing building, a dwelling house on an existing
lot, community residence on an existing lot, caretakers accommodation associated with
extractive industry, home based business, animal husbandry or cropping), on land affected
      by the Overlay.
