SPECIAL MEETING AGENDA 12 SEPTEMBER 2019

Amendments to Administration Local Law No. 1
        Schedule 1
The proposal seeks to amend Schedule 1 (Dictionary) to change the definition of ‘shared facility accommodation’
to include the words ‘does not include short stay letting’. The purpose of this amendment is to clarify the difference
between this proposed Local Law for ‘Short stay letting’ and an existing Local Law for ‘Shared facility
        accommodation’.
The proposed amendment to Schedule 1 is to include the new definition for short stay letting. Short stay letting is
the use of or making a premises available for holiday letting for a period of less than 3 months. It should be noted
that the premises only has to be available, not necessarily actually rented or used, for the premises to meet the
        definition of short stay letting.
The proposed definition of Short stay letting as set out in the Local Law No.1 is—
        Short stay letting—
           (a) means the provision, or making available, of premises for use by 1 or more persons, other than the owner
of the premises, for less than 3 consecutive months; but
           (b) does not include—
                    shared facility accommodation; or
il. the provision, or making available, of premises for use by 1 or more persons, other than the owner
of the premises, if the owner of the premises occupies the premises during the period of use of the
premises by the persons other than the owner
For clarity, provision (b)ii above is a home hosted situation where the owner is on-site and hosting guests in a
bedroom/s. For example, a traditional style hosted bed and breakfast or hosting a student/s for a couple of weeks
or a term is not included in Short stay letting and therefore a Local Law approval is not required.
        Schedule 2
An amendment to Schedule 2 is required to include another prescribed activity which is the ‘operation of short stay
letting’. The operation of short stay letting means the provision, or making available, on a commercial basis, of
short stay letting. It should be noted that the Local Law is only applicable for those premises where the operation
of short stay letting is on a commercial basis.

                                                                                                     2
