The submitters have advised that they accept the amended plans are an improvement and are
agreeable to settle the appeal.
It is therefore recommended that the appeal be settled, with some minor changes made to the
conditions to reflect the new plans.

That Council note the report by the Development Planner to the Planning & Environment
Committee Meeting dated 12 October 2021 regarding Application No. 51983.3225.14 for an Other
Change to an existing approval to Town Planning Consent 1632 for 25 x Multiple dwelling and 8
shops situated at The Hastings Lot 30/30 and Lots 7 & 11/30 Hastings St Noosa Heads and:
A.   Approve the application.
B.   Change condition 1:
C.   Include the following additional conditions 37 - 44 to read as follows:
     Additional Conditions specific for Lot 30 (and the use of Lots 7 & 11 for construction
     and access) – 21 October 2021
     Performance Bond - Planning
     37.   Security in the form of a cash bond or trading bank guarantee to the sum of $10,000
           must be submitted to Council, to secure performance of all conditions of this approval,
           specifically for Lot 30, prior to the issue of a Development Permit for Building Works.
           The cash bond or trading bank guarantee will be returned on performance of the
           conditions of approval less any costs incurred by Council in respect of enforcing
