SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 7 SEPTEMBER 2021

The proposed site of the Tiny Homes is zoned Recreation Open Space.
Relocatable homes is not a consistent use although Planning Regulations 2017, Schedule 6, Part 2,
s2(1) planning schemes are prohibited from making the following assessable development: A
material change of use of premises for a class 1 or 2 building, if the use is providing support services
and temporary accommodation for persons escaping domestic violence.
This proposed project qualifies for an exemption under Regulations 2017, Schedule 6, Part 2, s2(1).
iii) Flooding
Lot 69 RP41223 is located in an active water flow area. Whilst flood levels have not been recorded
for this land parcel, a Flood Information Certificate has indicated applicable minimum floor level for
habitable room/area which can be achieved through the tiny home design.
As the tiny homes are relocatable and have easy road access for evacuation if required, this has
been considered in YouTurn’s risk management plans and Council officers consider these plans to
be a satisfactory mitigation plan.
5. Tenure
Council Officers have recommended the following tenure arrangements:
Freehold Permit (3 years) to Noosa Community Garden Inc. over part of Lot 2 RP839623 at Wallace
Park for the purpose of relocation of the Noosa Community Garden and;
Freehold Lease (3 years) to YouTurn Ltd over Lot 69 RP41223 for the purpose of siting two (2)
prefabricated, relocatable tiny homes.
In accordance with the Local Government Regulation 2012 section 236, Council may enter into a
contract to dispose of an interest in a non-valuable asset including the granting of a lease over land
or a building without completing the tender process section 228 prescribes, if a relevant exception
applies.
Accordingly, the relevant exception is referenced in Section 236 (1) (b) (ii) whereby Council is not
required to tender of these properties as the purpose of the tenure renewals are to community
organisations. The requirement of this exception is that a relevant Council resolution is first obtained.
