PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 JULY 2022 Application No Applicant Application Details Fees & Charges Policy Fee proposed MCU21/0104 Applicant – RG MCU for Showroom, $24,695 $9,911 Strategic – 16 Caretakers Rene Street Accommodation & Noosaville Low Impact Industry The application is for a showroom for scooter sales, an area for scooter repairs (low impact industry) and a caretaker’s accommodation. The caretaker’s accommodation is a code assessable use in the medium impact industry zone. The low impact industry use is accepted development within an existing building and the showroom is impact inconsistent and therefore subject to a x3 multiplier. The applicant suggests that the fee is excessive and cannot be justified as: • The use is an existing use and has been operating since circa 2013 (repairing servicing and selling motorcycles/scooters and associated accessories); • The use is located in an existing building, and no assessment against setbacks, gross floor area, facades, or other physical attributes containing to the building’s exterior is required; • The use is complementary and consistent with the Rene Street Industrial precinct; • The showroom use is an integral part of the industry use, and without this component the use would not be finically viable; • Council has recently assessed a similar application made at this address and is therefore very familiar with the site and parameters (MCU19/0080); • The assessment fee of the showroom use prior to the multiplier ($7392) is excessive and is more than sufficient to assess this part of the application. The applicant proposes that the fee should be calculated on the basis of the work required to assess the showroom components of the application. The applicant is requesting that the fee multiplier not be applied in addition to 25% discount for use within an existing building for the showroom component. The fee the applicant is suggesting totals: $8,063 ($2,519 for the caretakers and $5,544 for the showroom). It is recommended that the multiplier not be applied in this instance, but the 25% discount not be applied given the applicant proposes changes to the external layout, including the provision of additional car parking on site and the matter will require a report to Council. The fee of $9,911 is considered appropriate. Application No Applicant Application Details Fees & Charges Policy Fee proposed DBW21/0116 Applicant – Tim Development Permit $1,195 $0 Bateup – 51 for Building Works Wirruna Drive for structure outside Cooran of Building Envelope The applicant submitted a DBW for structures outside of the building envelope, which was refused. The applicant submitted a complaint to Council relating to the decision. Upon investigation and a site visit, it was determined that Council did not appropriately consider all the material lodged and that a satisfactory outcome could be achieved with minimal change to the proposal plans. A new DBW is required to be lodged for assessment and it is considered appropriate to waive the application fee considering the fees previously paid. Page 129 of 150
