Delegated Report - Code - Planning MCU26 0003 (As Published)
• Senior Development Engineer, Development Assessment
Council’s Senior Development Engineer prepared a memo (Document Set ID 25010298) dated 24
July 2026 that includes the details of their assessment and recommended conditions to be included
in the Decision Notice.
• Senior Environment Officer, Development Assessment
Council’s Senior Environment Officer prepared a memo dated 24 July 2026 that includes the details
of their assessment and recommended conditions to be included in the Decision Notice.
The proposal generally indicates that the development can achieve a minimum of 20% of the site
as landscaped area (in accordance with PO6 of the Low Density Housing Code).
The revised proposal plans demonstrate that 270m2 of landscaping will be provided with the
proposed development exceeding compliance with the acceptable outcome AO6, noting that soft
landscaping includes all existing grassed areas.
• Heritage Advisor, Strategy and Environment
Council’s Heritage Adviser has assessed the proposal and acknowledges concerns regarding the
partial obscuring of the lower sections of the church windows by the proposed balustrade.
Notwithstanding this, the impact is considered acceptable from a heritage perspective for several
reasons.
All church windows are to be retained on every elevation of the building, ensuring the building’s
key heritage elements remain intact. The affected windows are located on the rear elevation, which
is generally considered the most appropriate location for alterations to heritage buildings. The
proposed balustrade will only partially obscure the windows, resulting in a minor visual impact.
Furthermore, this impact can be mitigated through the use of a light-coloured finish for the timber
balustrade and by painting the timber window frames in a contrasting darker colour, consistent with
the historic presentation of the church as shown in the heritage inventory photograph.
5. CONCLUSION & REASONS FOR DECISION
The proposed development generally complies with the requirements of the planning scheme and
does not raise any significant issues that cannot be addressed by reasonable and relevant
conditions. The application is therefore recommended for approval.
The proposal has been assessed against the relevant provisions of Noosa Plan 2020 (Amendment
2 – 26 September 2025) and is considered to achieve the intent of the Community Facilities Zone
Code, Low Density Housing Code and Hinterland Villages Local Plan Code.
The development retains an existing landmark building, preserves the established character of Kin
Kin, provides additional housing choice, maintains a low-intensity village-scale form, and does not
result in adverse impacts on surrounding land uses, amenity, infrastructure or environmental
values.
Importantly, the Noosa Plan Table of Assessment identifies a Dwelling House as a Code
Assessable use on the subject site, demonstrating that residential development is an anticipated
outcome on the land where the relevant assessment benchmarks can be satisfied. The proposal
is generally consistent with those benchmarks, subject to the provision of additional rainwater
storage if required.
Accordingly, the proposal represents an appropriate planning outcome and is considered to
warrant approval, subject to reasonable and relevant conditions.
The report is provided in accordance with Section 63(5) of the Planning Act 2016.
