  taken from an aerial photograph
The following image is from the survey plan provided by the applicant detailing the footprint of the
now demolished dwellings on the subject site and the existing dwellings on to the east and west of
the subject site.

Figure 10 – Survey plan provided by applicant

The applicant is proposing that the highest point of the roof at the frontage be setback 3.54 metres
from the front boundary whilst the highest point of the blade wall is proposed to be setback 3.9
metres from the front boundary. The average setback of all lots as detailed in the above table,
including corner lots, is 5.86 metres. Excluding corner lots the average setback is 5.91 metres.
Whilst it is noted that there are examples of non-complying setbacks within Toolar Street, these
are generally located on a corner lot or do not intrude into the front setback as extensively. It is
also noted that the more recent development which has occurred at 32, 36 and 37 Toolar Street
complies with the 6.0 metre setback requirement.
The proposed roof at a height of metres 7.3 metres above the existing natural ground level and
setback only 3.54 metres from the front boundary will dominate this part of the streetscape and be
inconsistent with the surrounding character. The development at the north-eastern corner of the
frontage is situated on approximately 1.4 metres of fill which will accentuate the dominance of the
intrusive built form when viewed from the street frontage and surrounding properties. The solid
blade walls will result in a heavy bulky form within the front setback particularly when viewed from
further along Toolar Street, also noting that the blade walls have a maximum height of 7.1 and 6.5
