Town Planning Report
28 Eenie Creek Road, Noosaville and parts of the road reserves of Hofmann Drive and Walter Hay Drive
The Cooloola-Great Sandy Region (Nominated National Heritage Property) will not be impacted directly by the
proposed development with indirect impacts, such as stormwater runoff, managed.
One ‘Vulnerable’ species was confirmed as present during the study (the Koala) along with one
‘Migratory/Marine’ species (the Rufous Fantail).
An assessment against the Department of the Environment’s Significant Impact Guidelines has indicated that
the proposed development is not likely to have a significant impact on these species or any other threatened
and migratory species that may utilise the study area.
Consequently, Cardno has concluded that the proposed development is a ‘not controlled action’.
The proposal will be referred to the Department of the Environment following the lodgement of this
development application. We anticipate this referral will take place during January 2015.
5.8 Aboriginal Cultural Heritage Act 2003
The Aboriginal Cultural Heritage Act 2003 establishes a cultural heritage duty of care which, amongst other
objectives, seeks to protect areas and artefacts of Aboriginal cultural heritage from disturbance, damage and
other potentially adverse impacts of development.
To the best of the applicant’s knowledge, no indigenous cultural heritage sites or values occur on that part of
the site over which application is made.
The applicant, in undertaking the proposed development, will take reasonable and practicable measures to
ensure the proposed development does not harm Aboriginal or Torres Strait Islander cultural heritage in
accordance with the Act and duty of care guidelines prepared by the Department of Aboriginal and Torres
Strait Islander and Multicultural Affairs and gazetted on 16 April 2004.
5.9 Nature Conservation Act 1992
The NCA provides for the conservation of nature and prescribes management principles for protected wildlife.
The NCA also makes provision for the prescription of specific requirements to recover or conserve wildlife
within a Conservation Plan.
Following the listing of the koala as a Vulnerable Species within the South East Queensland Bioregion in 2004,
the Nature Conservation (Koala) Conservation Plan (Koala Plan) was prepared and came into force on 2
October 2006. However the effect of the Koala Plan in relation to planning and development assessment has
since been replaced by the South East Queensland Koala Conservation State Planning Regulatory Provisions.
Elements of the Koala Plan, such as policies relating to sequential clearing, use of a koala spotter, the
rehabilitation of injured or sick koalas and translocation remain in place. In the case of the site, which is located
in Koala District A (broadly, South East Queensland), the sequential clearing requirements of koala habitat
trees under the NCA applies and koala spotters are required in koala habitat areas.
5.10 Environmental Offsets Act 2014
A new environmental offsets framework commenced in Queensland on 1 July 2014 with the intent, amongst
other things, of providing an outcome-based approach to offsets.
The new environmental offsets framework includes:
Environmental Offsets Act 2014 which coordinates the delivery of environmental offsets across
jurisdictions and provides a single legislative base for offsets in Queensland.
Environmental Offsets Regulation 2014 which provides details of the prescribed activities regulated
under existing legislation and prescribed environmental matters to which the Act applies.
Queensland Environmental Offsets Policy which provides a single, consistent, whole-of-government
policy for the assessment of proposed offsets provided by authority holders to satisfy offset conditions.
The new policy provides a number of options for the delivery of offsets, including:
financial settlement, calculated using a financial settlement offset calculator;
