Town Planning Report
28 Eenie Creek Road, Noosaville and parts of the road reserves of Hofmann Drive and Walter Hay Drive
6 Compliance Summary
6.1 Introduction
The following sections comprise a summary of compliance against the relevant provisions of the planning
framework as they apply to the proposed development, identified in Section 5 of this report.
More detailed information and responses to the relevant provisions of The Noosa Plan are included in the
Appendices to the Town Planning Report. Appendix A – Statement of Code Compliance is particularly
relevant in this regard, as it contains an assessment of the proposed development against the relevant codes
of The Noosa Plan.
6.2 State Planning Regulatory Provisions
The current State Planning Regulatory Provisions are listed in Section 5.2.4 of this report.
The following State Planning Regulatory Provisions are relevant to the proposed development:
South East Queensland Regional Plan 2009-2031 State Planning Regulatory Provisions;
State Planning Regulatory Provision (Adopted Charges); and
South East Queensland Koala Conservation State Planning Regulatory Provisions.
6.2.1 South East Queensland Regional Plan 2009-2031 State Planning Regulatory Provisions
The South East Queensland Regional Plan 2009-2031 State Planning Regulatory Provisions provide that
development is only contrary to, or inconsistent with, the State Planning Regulatory Provisions to the extent
the development is identified in Column 2 of Table 3A.
The proposed development is not identified in Column 2 of Table 3A of the South East Queensland Regional
Plan 2009-2031 State Planning Regulatory Provisions, and so is not contrary to, or inconsistent with, these
State Planning Regulatory Provisions.
These State Planning Regulatory Provisions also provide assessment criteria for development applications
involving a material change of use where involving an extension of more than 10,000m 2 of retail floor space.
These assessment criteria are therefore applicable to the proposal. Division 4 of the State Planning Regulatory
Provisions provides the following assessment criteria:
“4.1 Assessment criteria for development applications
…
The development must have regard to the provision of sufficient land with street frontage for non ‐retail
business premises.”
In the context above, ‘sufficient land’ is considered to be 15% of the proposed retail floor space.
Applicant’s Response
The proposed development is located on a site which forms part of the SBC.
The SBC is intended to develop as a MRAC and the highest order centre on the northern Sunshine Coast. It
is intended to be a multi-functional centre and the principal focus for business and employment development
in the subregion of the Noosa Shire. The SBC is intended to be developed in stages, consistent with a
demonstrated need, to become a dynamic and multi-functional centre that integrates a range retail,
commercial, industrial and community activities.
The SBC comprises a total land area of approximately 70 hectares which, under the current planning
framework, provides for a total theoretical development capacity of 197,300m 2 GFA across a range of uses,
including residential1.
