Town Planning Report
28 Eenie Creek Road, Noosaville and parts of the road reserves of Hofmann Drive and Walter Hay Drive
In two instances, in relation to Probable Solutions S1.1 and S19.2, compliance is not achieved and an
Alternative Solution is provided. These Alternative Solutions are discussed in Section 7 and Appendix A of
this report respectively.
In one instance, the proposed development does not comply with a Specific Outcome of the Building Works
Code, being O10 in relation to building height.
As the proposed development does not comply will all applicable Specific Outcomes, it does not comply with
the Building Works Code.
6.7.4 Biodiversity Overlay Code
The proposed development achieves compliance with most of the applicable Probable Solutions of the
Biodiversity Overlay Code.
In some instances Alternative Solutions to the provided Probable Solutions are proposed. Alternative Solutions
are proposed in relation to Probable Solutions S4.1, S8.1, S8.2, S9.1, S10.1, S11.1, S11.2 and S14.1-S14.4.
In all other instances Alternative Solutions are only proposed where an applicable Probable Solution is not
provided.
All Alternative Solutions provided demonstrate that the proposed development achieves compliance with the
corresponding Specific Outcome of the code.
The proposal therefore achieves compliance with all Specific Outcomes and the Biodiversity Overlay Code as
a whole.
6.7.5 Natural Hazards Overlays Code
The proposed development achieves compliance with all applicable Probable Solutions of the Natural Hazards
Overlays Code. Alternative Solutions are only proposed where an applicable Probable Solution is not provided.
The proposal therefore achieves compliance with all Specific Outcomes and the Natural Hazards Overlays
Code as a whole.
6.7.6 Community Uses Code
The proposed development achieves compliance, or can achieve compliance, with all applicable Probable
Solutions of the Community Uses Code. Alternative Solutions are only proposed where an applicable Probable
Solution is not provided. The proposal therefore achieves compliance with all Specific Outcomes and the
Community Uses Code as a whole.
6.7.7 Infrastructure Uses Code
The proposed development achieves compliance, or can achieve compliance, with all applicable Probable
Solutions of the Infrastructure Uses Code. In instances where a Probable Solution is not provided, an
Alternative Solution is proposed which demonstrates the proposal’s compliance with the corresponding
Specific Outcomes of the code.
The Infrastructure Uses Code states that development complies with the code if it is consistent with the Specific
Outcomes of the code. The proposed development achieves compliance with all Specific Outcomes of this
code.
6.7.8 Driveways and Carparking Code
The proposed development achieves compliance, or can achieve compliance, with most of the applicable
Probable Solutions of the Driveways and Carparking Code.
In some instances Alternative Solutions to the provided Probable Solutions are proposed. Alternative Solutions
are proposed in relation to Probable Solutions S7.1, S12.1, S13.1 and S19.1. These Alternative Solutions are
discussed in detail in Appendix D.
In all other instances Alternative Solutions are only proposed where an applicable Probable Solution is not
provided.
