Town Planning Report
28 Eenie Creek Road, Noosaville and parts of the road reserves of Hofmann Drive and Walter Hay Drive
SBC Precinct OS7 is one of the precincts shown on Map SBC forming the SBC. It represents the master plan
for the SBC. It is a graphical representation of indicative precincts and areas and predated development on
the site. Consequently SBC Precinct OS7 has not been surveyed, ‘ground-truthed’ or drawn with the level of
precision of a survey. SBC Precinct OS7, as indicated on Map SBC, is intended as an open space precinct for
environmental drainage purposes.
The Open Space Conservation Zone, which is intended to serve a multitude of purposes including maintaining
water quality and providing habitat and open space linkages, followed the SBC master plan. The location of
the Open Space Conservation Zone, which is very closely aligned to SBC Precinct OS7 (see Figure 7.6 above)
strongly suggests that the zoning is to give effect to the master plan precinct. That is, the zoning is intended
to support the maintenance of this part of the site for environmental drainage purposes.
Subsequently, the existing Noosa Civic was proposed, which involved ‘ground-truthing’ and documenting the
drainage corridor. This process gave rise to Covenant J, which was surveyed and registered on the title to the
site. Covenant J is therefore a more accurate representation of the drainage corridor and the vegetation within
it that is sought to be retained.
It is noteworthy that the existing Noosa Civic adopted Covenant J, rather than Open Space Conservation Zone
or SBC Precinct OS7, as the boundary to which development could be built. The existing Noosa Civic
development extends beyond the indicative boundaries of the Open Space Conservation Zone and SBC
Precinct OS7. It does not however extend into Covenant J.
For these reasons, the proposed development similarly adopts Covenant J as the boundary for development
within the expansion area, notwithstanding that it results in development extending beyond Precinct E1 and
into SBC Precinct OS7 and the Open Space Conservation Zone.
7.6.2 Development within Covenant J
The proposed development involves the following works within Covenant J:
clearing approximately 0.02ha adjacent to the southern boundary of the covenant area to create road
batters for the Hofmann Drive extension;
upgrading a culvert under Hofmann Drive to facilitate greater wildlife movement; and
constructing the elevated pedestrian link over the covenant area, which requires support structures
and footings within Covenant J.
