Response to Sub-item 1:
As noted in the town planning report, the proposal seeks a tailored approach to land uses and the
resulting flexibility for tenancies through seeking an ‘Undefined Use’ for the proposed Noosa
Marketplace development. This includes:
• Bespoke use definitions that more appropriately describe the development – refer Appendix A for
the full Undefined Use definition;
• Recognising that the planning scheme defined uses / use types could result in uses operating in
an inappropriate or inconsistent manner, or to be interpreted to be operating unlawfully;
• Allowing flexibility of land uses for small start-up businesses as well as more niche businesses,
consistent with Council’s expectations for parts of the site;
• Representing orderly development where individual and cumulative tenancy impacts can be
effectively managed through building design and managed through reasonable and relevant
conditions of approval.
The proposed Noosa Marketplace seeks to deliver a curated precinct-based experience, supporting
new and emerging businesses by creating a destination anchored with established ‘retail showroom’
uses that are attractive to both residents and visitors. The attractors will be national or emerging
brands which will drive visitation to the site, effectively supporting all the businesses that establish on
site.
We acknowledge that the proposed Noosa Marketplace departs from certain aspects of the current
Noosa Plan (Planning Scheme) and draft New Noosa Plan (Draft Plan – Rounds 1 & 2) however when
viewed as an integrated precinct we consider that the uses Council express as being of concern are
overstated.
The current Planning Scheme and Draft Plan envisage a range of uses over the site, thus it’s unclear
why Council feels it necessary to stipulate specific uses for individual tenancies.
To provide an example of the approach to provide flexibility for land uses within tenancies, Table 1
provides a comparison of one of the intended Undefined Use categories being ‘retail showroom’ and
provides commentary below on the similarities and differences. We contend that the proposed
definition is in our view more suitable.
