5.0         Local Planning


5.1         Level of Assessment

            As stated under Section 1.0 and Section 2.0 of this report, the proposed
            development requires ‘Code Assessment’, in accordance with Division 12 –
            Assessment table for development other than material change of use, Table
            8.10 within Part 8 – Mary River Catchment Locality Plan of the Noosa Plan.




5.2         Relevant Codes

            In accordance with Table 8.10 within Division 12 of Part 8 – Mary River
            Catchment Locality, the following codes are relevant to this application:


                       Mary River Catchment Locality Code;
                       Reconfiguring a Lot Code;
                       Landscaping Code; and
                       Engineering Works Codes.


            Whilst it is acknowledged that these codes are applicable to the proposed
            development, the Landscaping Code and the Engineering Works Codes are not
            considered necessary on the following grounds:


                       The proposal simply seeks approval for a boundary realignment, which
                        will not require any landscaping;
                       The proposed boundary realignment will not involve any site works on
                        the property which would require assessment of the Engineering Works
                        Code.


            An assessment of the remaining codes has been completed by Murray &
            Associates (QLD) Pty Ltd and provided in Appendix D.
