PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 6 SEPTEMBER 2016
The code sets out a number of specific outcomes and probable solutions for the works. The
following specific outcomes are of most relevance for the assessment.
O2.2 Prescribed tidal work not in a canal and for a non-private purpose is compatible with its
location, having regard to the following-
(a) The character and amenity of the work’s immediate surroundings and the locality within
which the work is located;
(b) If the relevant planning scheme states the desired character or amenity for the work’s
immediate surroundings or the locality within which the work is located – the stated desired
character or amenity
O3.1 Prescribed tidal work is of a height, scale and size to ensure the work is compatible with the
character and amenity of its location, having regard to the following:
(a) The height, scale and size of the natural features of the work’s immediate surroundings and
the locality within which the work is located,
(b) The height, scale and size of the existing buildings or other structures in the work’s
immediate surroundings and the locality within which the work is located,
(c) If the relevant planning scheme states the desired height, scale or size of buildings or other
structures in the work’s immediate surroundings or the locality within which the work is
located – the stated desired height, scale or size.
O11.1 Prescribed tidal works has appropriate infrastructure, including, in particular, road access,
parking facilities, sewerage services and water services, having regard to –
(a) The nature and scale of the work; and
(b) The number of people that may be on or at the work at any time; and
(c) The number of vehicles that may be on or moored at the work at any time; and
(d) The protection of any foreshores near the work and the vegetation and marine plants on
the foreshores
The following comments were provided by Council’s Coordinator Planning in regard to the
Watercourses Works Code of the Noosa Plan:
O4 Prescribed tidal work does not include extensions of on-site recreational areas unless there is
a clear demonstrated public benefit and public support.
The works are clearly designed to provide an extension of the on-site recreational, commercial
and public spaces on the site. The applicant submits existing outdoor dining areas will be
“transferred” to the new deck area but there is no mechanism under this approval for that to
occur. Overall the development will increase the amount of recreational, commercial and public
deck space on the site and the development does not serve any marine purpose. Instead, the
raised extension removes an existing docking facility on the northern side of the marina and
reduces the amount of “marine” activity on the site, replacing it potentially with further commercial
activity.
The increased deck area is likely to result in increased commercial activity on the site but the
development is unable to provide additional car parking to service additional activity. Car parking
demand at the existing development is regularly observed to significantly exceed the available
spaces at the development.
O5 Prescribed tidal works are designed and sited to ensure—
a) they are contained within the prolongation of boundaries of the lot;
b) that when a vessel is berthed it does not encroach over the prolongation of boundaries of
the lot;
