REPORT
This report is intended to enable Council to formally resolve to prepare a new planning scheme to
replace The Noosa Plan 2006.
1. Planning Legislation
The Noosa Plan 2006 was prepared under the Integrated Planning Act 1997. Since
commencement of The Noosa Plan, planning legislation has changed with commencement of the
Sustainable Planning Act 2009 which remains current. However the Queensland Parliament
recently passed the Planning Act 2016 which is anticipated to have effect in mid-2017.
This report recommends Council makes a decision to prepare a new planning scheme under the
Sustainable Planning Act 2009. Transitional provisions of the Planning Act 2016 enable the
planning scheme making process to be continued seamlessly under that Act when it takes effect
in 2017 (Section 286 of the Planning Act applies).
A planning scheme prepared under Queensland legislation ultimately requires approval of the
Minister, and to facilitate this process, the State Government provides specific guidance material
to councils in preparing new planning schemes. Apart from addressing local planning issues, a
new planning scheme is required to take account of broader inputs from the State Government
and these are called State Interests. The legislation outlines the process for preparing a new
planning scheme and more detailed requirements and specifications are contained in the
statutory guideline ‘Making and Amending Local Planning Instruments’.
