PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 6 SEPTEMBER 2016

2. The Noosa Plan 2006

The Noosa Plan commenced in February 2006 and built upon the approaches of the previous
town planning scheme, including the innovative 1997 Strategic Plan.

The Integrated Planning Act introduced a performance-based planning system for Queensland
and also a single integrated development assessment system. While previous planning schemes
had been very prescriptive, newer schemes were reliant on delivering (or at least enabling)
outcomes.

The Noosa Plan 2006 contains a Strategic Framework and Community Vision (which plays no
role in development assessment) and Desired Environmental Outcomes. It introduced a range of
development assessment provisions such as locality codes, land-use codes and mapping
overlays. The core provisions of The Noosa Plan were the land use zoning maps, use definitions
and the tables of assessment that indicated the type of process to be used to assess
development types.

The State Government also introduced triggers that required specified development applications
to be referred to various State agencies for assessment as part of the development process.

The SEQ Regional Plan 2005 also had a statutory influence on the provisions of planning
schemes in south-east Queensland, especially in relation to development outside of the Urban
Footprint.

3. The Sustainable Planning Act 2009 (SPA)

The Noosa Plan 2006 has similar effect under the Sustainable Planning Act as the Integrated
Planning Act, being authorised under transitional provisions. Section 91 of the SPA requires
councils to undertake a ten-year review of their planning schemes. The review must include an
assessment of the achievement of the strategic outcomes stated in the planning scheme. From
the review Council must:
(a) propose to prepare a new scheme; or
(b) propose to amend the scheme; or
(c) if the local government is satisfied the scheme is suitable to continue without
amendment—decide to take no further action.

Attached to this report is a review of The Noosa Plan. The review concludes that The Noosa
Plan has served Council and the Noosa community well but a new scheme is desirable for the
following reasons:
 Queensland Parliament has passed two planning Acts since 2006,
 New and updated plans and strategies have been adopted by Council in the interim, and
 It would be desirable to refresh many of the provisions.

Upon Council deciding to make a new planning scheme, the Minister is to be advised of that
decision. According to the statutory guideline, the notification to the Minister is to be
accompanied by a statement of the State interests expressed in a regional plan or State Planning
Policy the local government considers relevant, and how these may be integrated within the
proposed planning scheme. The statutory guideline also sets out the process for the State
Government to respond to Council about State interests. This information is important for the
drafting of the new planning scheme and the timing of this report is intended to allow sufficient
time for the State Government to respond this calendar year.
