GENERAL COMMITTEE MEETING AGENDA 12 SEPTEMBER 2022
Figure 5 – Rooftop Terrace Plan
Roof terrace
PO15 of the Low Density Residential Zone Code includes a requirement that rooftop
terraces:
do not create opportunities for residents or building users to overlook the private open
space or view into habitable windows or doors of neighbouring properties.
The issue of overlooking has been raised by nearby property owners to the north of the
subject site. The amended plans generally maintain the same rooftop footprint except for
the northern extent of the terrace which has been stepped back by 1.0 metre with a planter
now located in this area. A 1.4-metre-high screen has also been added to the northern
extent of the terrace. An 8.0 metre high canopy buffer is also proposed by use of a 1 metre
high planting strip adjacent to the northern boundary.
It is the applicant’s position that the angle between the eye line of an average person
standing on the terrace and the top of the screen at 1.4m effectively eliminates the
possibility of any overlooking to the area of concern. The applicant has provided the
following images to support the proposed 1.4-metre-high screen as suitable mitigation to
overlooking. The first image suggests that there is no overlooking within 21 metres of the
common boundary.
