EXECUTIVE SUMMARY
A report for this application was presented to Council at the Planning and Environment
Committee meeting dated 6 September 2022 recommending approval of the application
subject to conditions. The matter was considered at the Committee meeting where
Councillors raised concerns as to the following:
presentation of the building to Emerald Street;
whether an additional PWD (person with disabilities) carpark could be provided on site;
and
whether there was the ability to provide additional PWD carparking within the area.
A further report was requested to be provided to the General Committee detailing conditions
of approval relating to the building design and if appropriate an additional PWD carpark.
The applicant was contacted regarding the above issues and subsequently indicated that
they considered the design complied with the Noosa Plan requirements and requested that
the matter be assessed as they intended to commence construction as soon as possible.
The application is recommended for approval as it is considered to comply with provisions of
the Noosa Plan 2020 and this recommendation is detailed below however a further motion
which includes additional conditions relating to building design is also provided, if Council
decides that alterations are required to the design.
No condition has been prepared in relation to an additional PWD carpark as this is not a
reasonable nor relevant condition.
Additional Conditions
The parapet to the Emerald Street frontage is to be removed and replaced with a hip
roof design.
All deck and balcony areas above ground floor must not be enclosed by permanent
fixtures such as shutters, louvres, glass panelling or the like, except where required to
satisfy any privacy condition of this Decision Notice or if shown on the approved plans.
Street awnings must be provided for the full frontage of the building to Emerald Street.
The awning must be designed to provide maximum continuous solar and rain
protection and promote all weather activity but provide opportunities for street tree
planting and landscaping. The width of the awning must be determined in consultation
with the Manager Development Assessment prior to the issue of the operational works
approval and is to include a sloping roof form. Posts are to be provided and must be
located to the outer most point of the awning so as not to impede pedestrian traffic.
