PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 9 DECEMBER 2014
B. Find the following are sufficient grounds to justify the decision despite the conflict with the
Planning Scheme:
1. The development allows the re-use of the existing industrial building on the site and
improved built form, landscaping and environmental outcomes on the site; and
2. The site has existing use rights for a major industrial use (brickworks), which is also
categorised as an Industrial Use Type 2 under The Noosa Plan, and the proposal is
of substantially lesser intensity
REPORT
1. PROPOSAL
The application seeks approval for a Material Change of Use of Premises for an Industrial
Business - Type 2 “Production, alteration, repackaging & repairing” for additions and changes to
the approved Wimmers soft drink factory. A development permit for relocation of the factory onto
the site was approved in 2013 and the application seeks to make amendments to the approved
plan and expand the use area of the factory into an additional bay of the existing industrial
building (former brickworks).
The proposed amendments and additions comprise:
Amended proposal plans for the approved factory area changing the front façade, internal
reception and office layout
Additional factory floor area occupying additional bay of the existing industrial shed, adding
3,021m2 in floor area to the approved 5,560m2 soft drink factory
Additional carparking and manoeuvring areas at the front of the site with an additional
access driveway to be added.
Despite the increase in floor area, the applicant advises that the factory operation will not
generate additional staff numbers and heavy vehicle movements will remain within the currently
conditioned limit of 10 return truck trips per day. The application material further states:
Upon commencement of operations the Wimmers Factory will provide for the employment of
approximately 20 employees. The hours of operation will be within standard business hours (i.e.
7am to 5pm, Monday to Saturday) with current capacity generated at a maximum of 2,000 litres
of product per day. During cooler months (i.e. around winter) production outputs are typically
reduced. The proposed extension in Gross Floor Area of 3,021m2 will allow for an increase in
manufacturing and storage areas, which will result in an increase of production as required
during peak operations. As previously outlined, an estimate of production has not been
determined however, it is understood that it will not exceed over 20,000 tonnes annually.
A copy of the proposal plans is included as Attachment 1.
2. SITE DETAILS
2.1. Background
The original brickworks operation pre-dates any town planning scheme for the Noosa area and is
understood to have operated for approximately 60 years.
An application seeking town planning consent to extend the kiln and dryer of the brickworks was
approved by Council on 22 October 1980.
On 21 October 1981, Council resolved to approve a further town planning consent to erect a
shed for clay storage (TPC 1487).
