PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 9 DECEMBER 2014

Of these, the statutory planning instruments relevant to this application are discussed in the
sections that follow.
3.2. State and Other Statutory Instruments
State Planning Policy

The proposal meets the Integrated Development Assessment requirements of State Planning
Policy 2014.
South East Queensland (SEQ) Regional Plan 2009 - 2031
The site is located within the Urban Footprint of the SEQ Regional Plan. The proposal is
consistent with the regional policies of the SEQ Regional Plan.
State Planning Regulatory Provisions
The following State Planning Regulatory Provisions apply to the application:
 SEQ Regional Plan Regulatory Provisions
The proposal is for an urban activity within the Urban Footprint and is consistent with the SEQ
Regional Plan Regulatory Provisions
3.3. Statutory Instruments – Planning Scheme
The subject site is located in the Cooroy and Lake Macdonald Locality and is zoned Detached
Housing. The proposed subdivision for detached housing is identified as consistent within the
zone and is required to follow a code assessable application process.
Locality Provisions
Cooroy and Lake Macdonald Locality Code
The proposal provides a low density housing estate that offers residential amenity consistent with
the developed character of Cooroy. The lots overlook, adjoin or are near a proposed park, with
pedestrian and bicycle pathways provided from the end of the new road to an existing pathway
which connects to the trunk pathway along Lake Macdonald Drive. The proposal complies with
the provisions of the Locality Code.
Land Use & Works Provisions
The following codes which regulate land use are most applicable to this application:
 Reconfiguring a Lot Code
 Landscaping Code
 Engineering Works Codes
The application has been assessed against each of the above codes. The pertinent issues
arising out of the assessment are discussed below:
Reconfiguring a Lot Code
Lot layout, Shape and Size
The residential lots are fully serviced and range in size from 654m² to 849m² complying with the
minimum lot size of 600m² required by the Code. The development offers a variety of lot sizes
and shapes in accordance with the provisions of the Code.
Earthworks
The lots are proposed to be re-profiled to provide level building platforms, which results in
retaining walls up to 1 metre above the natural surface level on some lots. This is preferable as
the developer will undertake the cut and fill works rather than individual owners or builders, which
often results in inconsistent or sub-standard works and surface drainage issues. The fill is not for
flood immunity and will not adversely impact on the waterway course or riparian vegetation.
