PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 15 SEPTEMBER 2015
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Sustainable Planning Act 2009 the application must be assessed against each of the
following statutory planning instruments to the extent they are relevant to the development:
State Planning Policies;
the South East Queensland Regional Plan;
State Planning Regulatory Provisions;
any Structure Plan or Master Plan in place for declared areas;
any Preliminary Approval Overriding the Planning Scheme for the land;
the Planning Scheme for the local government area; and
any Temporary Local Planning Instrument in place for the local government area.
Of these, the statutory planning instruments relevant to this application are discussed in the
sections that follow.
3.2. State and Other Statutory Instruments
State Planning Policy
The State Planning Policy July 2014 identifies issues of State significance that must be considered
in the assessment of new development. The proposal triggers assessment against the Policy’s
Interim Development Assessment Guidelines regarding biodiversity, coastal environment, water
quality, natural hazards and public transport. The development is broadly able to meet the State
provisions but does raise some issues and consideration with regard to biodiversity and public
transport, which are discussed in further detail in Section 3.3.1 of this report.
South East Queensland Regional Plan 2009 - 2031
The site is located within the Urban Footprint area of the South East Queensland Regional Plan
(SEQRP) and is identified as a Major Regional Activity Centre (MRAC) within the Plan’s
commercial centre hierarchy for the Sunshine Coast, with Maroochy identified as the Principal
Regional Activity Centre (PRAC).
The stated purpose of the Regional Plan is to manage growth and change in the most sustainable
way to protect and enhance quality of life in the region. Its strategic and policy provisions are
relevant to the application, given the NBC’s regional planning status and the development’s
departure from the planning scheme intent for the site.
The SEQRP’s includes a sub-regional narrative for the Sunshine Coast. The Plan’s narratives are
stated to:
… have the status of policies under the SEQ Regional Plan. They:
provide more detailed information about the pattern of expected growth in each local
government area, which will be necessary to achieve the regional plan’s outcomes
address the planning and delivery of land for employment growth across the region
identify the key infrastructure priorities that will support expected growth
set out and explain the appropriate approach to development for each local government area
in the region.
