GENERAL COMMITTEE MEETING AGENDA 15 AUGUST 2016
This issue of how Local Governments have to undertake preparation of LGIPs should
be no different to the way the State has undertaken preparation and implementation of
its own State Infrastructure Plan which is identical to an “Interim LGIP amendment”.
The current LGIP requirement is considered completely contrary the statement on
Department of Infrastructure, Local Government and Planning website page “BETTER
PLANNING FOR QUEENSLAND” quote:
'We believe that planning reform can deliver a more efficient system that supports
investment and jobs, but don't believe this must come at the expense of community
participation or the role of local government'.
Deputy Premier, Jackie Trad (May 2015)
For further clarification, justification and backup information that the three aspects
within the motion proposed were once in the instruments, then removed, and
subsequently re-imposed, additional details are provided as follows:
a) Costing of existing assets and catchment demand allocation:
Was first required in ICS component of PIP under IPA in September 2004 and
carried on through SPA. (Note ICP’s i.e. Noosa’s adopted and implemented
CMRNICP did not require existing costing but did require catchment demand
allocation across future costs that determined charge rates for future
development).
Was then removed in 2011 legislative amendment where PIPs no longer
required ICS component.
Re-imposed in 2014 legislative amendment through Statutory Guideline 03/14.
b) Third party reviews of draft LGIPs:
Was first required in ICS component of PIP where 3 rd party review was
undertaken by Queensland Competition Authority (QCA) and paid for by the
State Government but it still cost local governments a ton of money through a
year of staff time explaining and going through everything in detail with the
QCA’s consultants.
Was then removed in 2011 legislative amendment where PIPs no longer
required ICS component and QCA review. PIP details could then temporarily
form part of an local government’s “Adopted Infrastructure Charges Resolution”
prior to adopting PIP’s that also no longer required this 3 rd party review
(however still required State approval).
Re-imposed in 2014 legislative amendment through Statutory Guideline 03/14
but this time with the additional cost for local government to additionally engage
and pay for the independent reviewer.
c) Simplifying all LGIP review and approval processes:
Pre and post IPA and SPA, infrastructure planning and charging details could
be undertaken through PSP’s and their simple process until completion of
ICP’s and then PIPs. (PSP’s also continued in force up until the 2011 legislative
amendments).
ICP process commenced under IPA 1998 and continued through SPA but only
with State reviews. PIPs with ICS processes introduced under IPA in
September 2004 with QCA review in addition to State review and continued
through SPA.
PSPs, ICPs and ICSs ceased under 2011 legislative amendment where PIPs
no longer required ICS component and PIP details could form part of a local
government’s Charges Resolution prior to adopting PIP’s through a simplified
process (i.e. without 3rd party review, existing infrastructure costings and
network demands etc.). This also made it much easier and quicker for
Department’s State review as evidenced by the large number of simplified
PIP’s being approved and adopted.
