SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 8 MAY 2018
It is also proposed that the license approved by Council and issued to RRA be varied to include:
A requirement for RRA to undertake mattress processing, including recovery for reuse of
foam and any useful cloth material.
4. Procurement Implications
The license issued by Council did not contain any payment to RRA at the time it was approved.
The value of the proposed new relief staff contract ($350,000) and variations to the license to
have RRA undertake mattress recycling ($262,500) over the seven year period both constitute a
“large sized contract” and under Council’s standard procurement practices should go to tender.
In this instance, Council staff believe that tendering the services is not practical nor cost effective
under the circumstances, based on the following:
Employing Agency or casual staff to relieve Council’s weighbridge operators for a half an
hour lunch break at Eumundi Road Landfill would require a three hour call out fee whereas
RRA staff will be simply able to walk across to the weighbridge as part of their normal
duties;
More than 1 trained person able to use the wasteman software needs to be available for
relief at short notice – i.e. sick leave. Employing a casual or range of casuals and paying
them to be on standby to ensure they are available is impractical;
Operating the weighbridge software used at all sites is complex and takes significant
training and refresher training if not used regularly;
Mattress processing provided by RRA includes WH&S supervision and other onsite
supervision, not available if another tenderer were to take on this role;
RRA has the role of recycling goods at the Eumundi Landfill;
RRA indicated they could offer the mattress processing service in their tender submission
for a cost and would have an expectation that another contractor would not be offered this
role; and
Mattress processing is directly linked to the other recycling and value adding services to be
performed by RRA.
5. Local Government Regulations
Section 235 (a) and (b) of the Local Government Regulations provides an option for Council
under these abovementioned circumstances.
Section 235 - Other exceptions
A local government may enter into a medium-sized contractual arrangement or large-sized
contractual arrangement without first inviting written quotes or tenders if—
(a) the local government resolves it is satisfied that there is only 1 supplier who is reasonably
available; or
(b) the local government resolves that, because of the specialised or confidential nature of the
services that are sought, it would be impractical or disadvantageous for the local government to
invite quotes or tenders; or
(c) ……………..
(d) …………..
An exemption from tendering the services requires Council to form an opinion and pass a
resolution that the exemption complies with criteria detailed in section 235.
