EXECUTIVE SUMMARY
Not applicable.

RECOMMENDATION
That Council note the report by the Governance Advisor to the Services & Organisation
Committee Meeting dated 8 May 2018 and pursuant to section 257 of the Local Government Act
2009, agree to delegate to the Chief Executive Officer the powers outlined in the updated Local
Laws Delegation of Authority provided at Attachment 1 to the report.

REPORT
1. Update to Council’s Local Laws Delegation of Authority

Pursuant to section 257 of the Local Government Act 2009 (LGA), a Local Government, may by
resolution, delegate a power of the Local Government under the LGA or another Act to:
 The Mayor; or
 The Chief Executive Officer (CEO).

Pursuant to section 259 of the LGA, a CEO may on-delegate powers that have been delegated to
CEO from Council.

As a general guide, where a legislative instrument or local law refers to a particular power of a
‘local government’ this is a power of Council and therefore, that power is only able to be
exercised by Council unless that power has been appropriately delegated to the CEO and then
on delegated to employees (where appropriate).

The current Local Laws Delegation of Authority has been updated to include the Noosa Shire
Council Local Law No 7 Waste Management 2018, which was made by Council at the Ordinary
Meeting of 15 March 2018.

By Council delegating its powers under Local Law No 7 Waste Management 2018 to the CEO,
the CEO is then able to on-delegate relevant powers to appropriate Local Laws and Waste and
Environmental Health team members for operational purposes.
