GENERAL COMMITTEE MEETING AGENDA 12 OCTOBER 2020

   Specific Outcome O8 of the Noosa Heads Locality Code requires that:
   Buildings and other structures are appropriately designed and sited to—
   a) provide amenity for users of the premises as well as preserve the visual and acoustic
      amenity of adjoining and nearby properties;
   b) provide adequate distance from adjoining land uses
   c) preserve any existing vegetation that will buffer the proposed building;
   d) allow for landscaping to be provided between buildings;
   e) maintain the visual continuity and pattern of buildings and landscape elements within the
      street;
   f) protect public safety and property within erosion prone areas by ensuring such areas are
      maintained largely free of development; and
   g) help protect the natural character and visual amenity of coastal areas and watercourses
   Whilst the proposal does not meet the minimum boundary setbacks to Hastings Street under
   Probable Solution S8.1, the development complies with Specific Outcome O8 and
   maintains the existing setback approved under TPC1008 (original approval for western
   portion of building).
   The new roofing over the Providore outdoor dining area improves the amenity of users of the
   dining area by providing weather protection, without detrimentally impacting on the visual
   and acoustic amenity of adjoining and nearby premises. In addition, the proposal includes
   changes to the on-site landscaping (to be assessed through a separate subsequent
   Operational Works application), including maintaining existing vegetation and providing
   improved planting within landscaped planters located on the Hastings Street boundary. The
   updated landscaping will preserve much of the existing vegetation on the site, with
   improvements to the landscaping ensuring visual continuity along Hastings Street in terms
   of landscape elements within the street.
   In addition, Overall Outcome m) of the Noosa Heads Locality Codes states:
   Hastings Street’s character of low rise buildings, vibrant pedestrian friendly streetscape, mix
   of indoor and outdoor activities, diverse dining opportunities, specialty Retail businesses and
   pedestrian links to Main Beach is maintained.
   As a result, Hastings Street has developed over the years as an area dominated by outdoor
   dining activities, with many sites located along Hastings Street offering outdoor dining located
   both within the front boundary setback and within the road reserve (approved through
   Outdoor Dining Permits issued by Council’s Property branch). Therefore the proposal to
   include outdoor dining within the front setback maintains the visual continuity and pattern of
   buildings within the street.
   It is also noted that an architectural Peer Review was carried out by NRA-CO-LAB (Noel
   Robinson) on behalf of Council. The Peer Review included the following comments:
    The alterations to the entry of the site have provided good street presence to the
         Providore tenancy.
    Site entry has been improved from the perspective of pedestrian experience.
   The Parade (beach) Setback
   The proposal includes the following non-compliances with the setback requirements to The
   Parade (beach) boundary and as such, are required to be assessed against Specific
   Outcome O8 of the Noosa Heads Locality Code:

                                                                                   Page 26 of 84
