PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 DECEMBER 2018
Furthermore, the applicant indicated that up to 180 persons would be onsite by special invitation for
product release events. Condition 5 of the approval supports this by requiring product release events to
be held after 5pm.
The proposal seeks 481m² of Use Area for the Entertainment and Dining Business Type 1 – Food and
Beverages which comprises approximately 65% of the approved industrial business Use Area of 742m².
Council’s advice has been consistent in that the entertainment and dining component must be subordinate
to and associated with the industrial business on site. Figure 8 below shows the proposed areas for the 2
uses on site.
Figure 8 – Red shading indicates Entertainment and dining business and purple shading Industrial business.
Concerns are raised with the significant increase in the scale of Entertainment and Dining Business use
and regular activities as happy hour, trivia nights, live music, open mic nights and other events and the
reduction of the industrial floor area. The operation is generally reflective of a hotel enterprise or a
‘brewpub’, where a hotel, tavern, bar or the like sells alcoholic beverages brewed on site. Given the
significant increase in scale of the Entertainment and Dining Business, it is considered the proposed
changes to ratify the current operation, are not an Entertainment and Dining Business Type 1 – food and
Beverages use but constitutes a new use on site; an Entertainment and Dining Business Type 3- Bar.
It is pertinent to note that the applicant does not agree with this determination and further indicates:
In relation to this matter, we would submit that the proposed minor change will have no impact on the
current and future use of the site as a primarily industrial land use. In particular, we submit that:
The business operates as a boutique brewery, and typical of other boutique breweries includes an
opportunity for food and drink provision as an ancillary and associated use;
The applicant has provided Council with concept plans showing expansion plans for the brewery
operation, which will over time reinforce the primary use of the site as a working brewery;
The expansion of the brewing area over time will extend into the proposed Flexible
Function/Industry Area, reducing the amount of floor space available for the non-industrial uses on
the site; and
No fixed plant or equipment such as chairs, tables or booths are located within the Flexible
Function/Industry Area, meaning that when this minor aspect of the overall site use is not operating
the entire floor space remains available for industrial production.
