PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 DECEMBER 2018 On this basis, we would respectfully submit that the current and proposed nature of site operations does not alienate or interfere with the use of the land for industrial activities, and instead represents a modern industrial land use that leverages on the attributes of site production activities. It is disagreed the land use represents a modern industrial land use but is considered an Entertainment and Dining Business Type 3 - Bar. (b) results in the application applying to a new parcel of land; Applicant’s response: The proposed changes do not result in the application applying to a new parcel of land. Assessment: Agree (c) dramatically changes the built form in terms of scale, bulk and appearance; Applicant’s response: The proposed change enables the use of an internal room within the building to be used for both production and entertainment uses. The co-locating of these uses will not affect the built form of the approved development. The use of the outdoor area for the purposes of a children’s play and supervision area will only require the installation of fences and the inclusion of translucent roofing over an existing pergola. The change will not involve the erection of walls or additional shade structures. The proposed changes will not result in a scale, bulk and appearance that is significantly different from what was original approved and will not result in altering any aspects of the development that may impact the character of the local area. Assessment: The roofing of the northern pergola and a children’s play area will not significantly change the scale in terms of built form, bulk or appearance. (d) changes the ability of the proposed development to operate as intended; Applicant’s response: The proposed changes will enable the development to operate as originally intended as discussed within Council during prelodgement discussions for MCU16/0133 and OPW16/0247. The repurposing of some areas for a combined production and entertainment uses will still be within the intention of the existing development permit. Assessment: The Entertainment and Dining Business was approved to operate subordinate to the industrial business on site. The approval limits the Entertainment and dining business to 120m² with no use of the outdoor area facing Venture Drive and limits operating times for product release events to ensure the use is subordinate to the industrial business. The repurposing of some of the industrial floor area will significantly increase the scale of the Entertainment and Dining Business component and physically reduces the scale of the industrial businesses area. Given the increased scale and nature of the Entertainment and Dining component, it is considered these changes will inhibit the Entertainment and Dining use to operate subordinate to the industrial business. (e) removes a component that is integral to the operation of the development; Page 53 of 72
