EXECUTIVE SUMMARY
Not applicable.

RECOMMENDATION
That Council note the report by the Planning Scheme Project Manager to the Planning &
Environment Committee Meeting dated 7 November 2017 and:
A.                       Discontinue preparation of the new Planning Scheme under the Sustainable Planning Act
                         2009;
B.                       Propose to make a new Planning Scheme for the whole of Noosa Shire under the Planning
                         Act 2016;
C.                       Advise the Minister of this decision;
D.                       Authorise the Chief Executive Officer to prepare an amended Statement about State
                         Interests and to consult with the Chief Executive of the Department about the matters to be
                         included in the notice under Section 18 of the Planning Act; and
E.                       Adopt the Draft Communications Strategy (Summary) as set out in Attachment 2 to the
                         report in principle and request that Chief Executive Officer provide a further report to the
                         Council regarding a detailed community consultation activities plan at the time the Council
                         re-considers the draft planning scheme following the first state interest review.



REPORT
This report is intended to enable Council to formally resolve to prepare a new planning scheme to
replace The Noosa Plan 2006. Council has previously resolved in September 2016 to prepare a
new planning scheme under the Sustainable Planning Act (SPA), a copy of that decision is
included later in this report. However, since that decision the Sustainable Planning Act has been
repealed and replaced by the Planning Act 2016 which commenced on 3 July 2017.

1.                       Continuing Preparation of the new Planning Scheme under the Sustainable Planning
                         Act 2009
At the time of Council’s decision in September 2016, introduction of the Planning Act was
estimated to be some nine months subsequent and a delay of that length to await the
introduction of the new act for commencing the new planning scheme caused concerns.
