PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 NOVEMBER 2017
3. Procedural Steps under the Planning Act 2016
Section 18 of the Planning Act sets out the procedures for making a new planning scheme. A
copy of Section 18 is Attachment 1 to this report. Note that the Chief Executive (of the
Department of Infrastructure, Local Government and Planning) must respond to Council’s
decision to make a new planning scheme by consulting with Council and subsequently issuing a
notice setting out the various matters in section 18(5), including how public notification of the
proposed planning scheme is to be given and Council’s proposed communications strategy for
the planning scheme.
To assist in consulting with the Chief Executive about the communications strategy, staff have
included in this report a draft communications strategy in summary form as Attachment 2. This
summary reflects activities undertaken for the Discussion Paper in 2016 and is presented as
preliminary. Staff propose Council endorse this summary as its current intention for the
community engagement strategy. Note the Act nominates 40 business days as a minimum for
public consultation. Staff propose a more appropriate consultation period for our community is
60 business days.
In addition, staff propose to report further to Council about community engagement after we have
received the Chief Executive’s notice and prior to commencement of community consultation
about the new planning scheme. This will allow Councillors an opportunity to consider any
additional activities to undertake during the consultation period.
The Minister has also published Guidelines and Rules for making or amending a planning
scheme and the Department has issued guidance material about those Rules.
