PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 16 September 2014

Impacts of construction start times on The Environmental Protection Act regulates that
neighbours – request start after 7:30 am. construction activities do not commence outside of
the hours 6:30am to 6:30pm Monday to Saturday
and no construction on Sundays or public holidays.
Special concessions are sometimes given for
Hastings Street, however in this instance it is not
considered appropriate to regulate the construction
commencement time not in accordance with the state
law.

the building is setback more than 31m from the
existing units across the road. This setback meets
the Probable Solution of the code and is considered
to be an adequate setback, so as not to result in
overlooking issues.

5. CONCLUSION
The proposed development is for Multiple Dwelling Units (4 units) on a 1,619m2 site, within
the Semi Attached Housing zone at 28 Nannygai Street, Noosaville. The development is
identified as an inconsistent use within the zone.
Despite the inconsistency with the zone, the application has been assessed against the
provisions of The Noosa Plan and does not raise any significant planning concerns. The site
is surrounded by existing multiple dwelling units and is only one block away from the Major
Road Network (Weyba Road) and 150m to the Business Centre zone (Aldi and Lake Weyba
Drive restaurants).
While the proposed use raises a conflict with the Noosaville Locality Code, it is considered
that the following grounds are sufficient to support the proposal:
• The proposal provides for a high level of residential amenity, consistent with the
surrounding development in the area and The Noosa Plan requirements for the Semi
Attached Housing zone; and
• The development is located within convenient access to the major road network and
surrounding shops.
• The proposed built form is equivalent to 2 duplex developments, which is consistent
with the permitted development on the site.
The application is therefore recommended for approval, subject to conditions.
