5 Local Framework

5.1 Local Planning Instrument
The Noosa Plan 2020 – Amendment 1 is the applicable planning scheme for the Noosa Shire Council Government
Area and provides the relevant framework for development assessment and approval. The provisions of the Noosa
Plan 2020 that are relevant to the proposed development are identified and addressed in the following sections of
this report.


5.2 Category of Development and Assessment

5.2.1 Category of Assessment
In accordance with part 5 of the Planning Scheme, the proposed development is assessable development and is
subject to Code assessment. The assessment benchmark for the proposed development is the planning scheme,
and specifically the codes outlined in Table 8.

5.2.2 Assessment Benchmarks
This development application has been prepared to demonstrate compliance with the applicable provisions of the
relevant assessment benchmarks. The assessment benchmarks which are applicable to the proposed
development are listed in Table 9, with the relevant codes being addressed in a consolidated package and
provided in Attachment 4.

                                                          assessment against the Bushfire Hazard Overlay code is not
                                                          required.

 Landslide Hazard Overlay code           Not Applicable   In accordance with Table 5.9.8 of the planning scheme, an
                                                          assessment against the Landslide Hazard Overlay code is not
                                                          required. Notwithstanding, the proposed development is located
                                                          entirely outside of the mapped Moderate Hazard Area sub-category
                                                          of the Landslide Hazard Overlay and as such, does not require
                                                          assessment against the overlay code.

 Local Plan Codes

 Coastal Communities code                Not Applicable   In accordance with Table 5.7.1 and 5.5.2 of the planning scheme,
                                                          an assessment against the Coastal Communities Local Plan code
                                                          is not required. However, for completeness a response to the
                                                          overall outcomes of the Coastal Communities Local Plan code has
                                                          been provided in Table 9.
