2. SITE DETAILS
2.1. Background
A building approval was issued for the construction of a dwelling in 1999.
An application for a Development Permit for Material Change of Use of Premises - Infrastructure
Uses - Service & Utility Type 3 – Tower & Operational Works (access and waterway barrier works)
was decided by Council at its Ordinary meeting on 20 April 2017. The approval permitted the
construction of an NBN tower with a vertical height of 46m west of the existing waterway and outside
of the riparian buffer area.
The applicant made representations on 17 May 2017 to the development approval conditions. The
representations related to changes to conditions 4, 6, 12 & 16, regarding overall height, noise limits,
and exposure to electromagnetic emissions and landscaping. A negotiated decision notice issued 7
June 2017 via delegation approved changes to Conditions 12 and 16 relating to health and safety of
electromagnetic emissions and landscaping. Changes to conditions 4 and 6 were refused.
