PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 JUNE 2021
On 11 June 2020 ‘another change’ to the approval was issued. The approval resulted in the inclusion
of the neighbouring lot to facilitate an access easement over an existing waterway way crossing.
The Waterway Barrier Works component of the original approval was removed with the state’s
agreement these works were no longer required.
2.2. Site Description
The topography of the subject site is relatively flat with ground levels ranging from 4m relative to
Australian Height Datum (AHD) at its lowest point along the southern boundary to 9m AHD at the
highest point near to the eastern boundary.
The eastern portion of the lot is mostly cleared with grassed paddocks. The western portion of the
site is sparsely vegetated with predominant regrowth wattle and melaleuca.
A watercourse intersects the site and travels the full width of the lot from the southern to the northern
boundary. The waterway is included as a Riparian Buffer Area under the Biodiversity, Waterways
and Wetlands Overlay of The Noosa Plan 2020. The waterway and associated riparian buffer area
are ‘ecologically important areas’ as defined by the planning scheme. The riparian buffer area
contains native vegetation in a riparian zone, regrowth vegetation that is likely to develop into a
Matter of Environmental Significance, a waterway and wetland.
An existing internal track provides access from the driveway to the east of the lot. An existing culvert
provides vehicular access over the waterway.
A ‘tiny house’ and associated infrastructure was placed in the riparian buffer area some time in 2020
contrary to the Noosa Plan requirements.
2.3. Surrounding Land Uses
Surrounding premises are semi-rural in nature featuring open paddocks and partially vegetated
areas. Neighbouring properties feature detached houses and rural settlement/ rural lifestyle blocks
with associated outbuildings. The property to the west is a heavily vegetated public reserve.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017;
Noosa Plan 2020.
3.2. State and Other Statutory Instruments
State Planning Policy
The Noosa Plan 2020 is generally consistent with the State Planning Policy July 2017 (SPP) and the
SPP raises no further issues relevant to the proposed development.
South East Queensland (SEQ) Regional Plan
The site is located within the Rural Living Area of the SEQ Regional Plan. The proposal is consistent
with the regional policies of the SEQ Regional Plan.
Planning Regulation 2017
The site is identified as a Koala Priority Area and it is noted that the proposal could be conditioned
to comply with the relevant assessment benchmarks from the Planning Regulation 2017.
