PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 FEBRUARY 2017

- Incorporate vehicle gates so as to close off the deliveries area and service from public
      access.
- Increase opportunities for casual surveillance of the rear podium car park (not relying solely
      on CCTV)”
A copy of the consultant’s full architectural review is included as Attachment 1.
2. ASSESSMENT
The architectural peer review conclusions were raised with the applicant and the applicant
subsequently agreed to amend their proposal plans. The amended plans are included as
Attachment 2.
The applicant has also advised that they accept the findings of this peer review and make the
following points:
 The bin location proposed in the peer review will not work from an amenity perspective with
issues such as ventilation and odour impacts experienced by patrons on the terrace.
Therefore, we will comply with the request to screen the bin, but will not relocate it to the
peer reviewed location for these reasons.
 Regarding the windows requested within the gaming room, this is actually illegal.
Reference is made to the Gaming Machine Regulation 2002 s7 titled ‘Gaming Equipment’
      which states:
The licensee must ensure that no gaming equipment in the licensee’s licensed premises is
      readily visible to passing pedestrians.
 The significant feature trees to Pelican Street will result in the loss of on site car parking.
 The applicant is willing to accept a condition requiring closure of the driveway to Doonella
      Street after 7pm.
The amended plans generally address the matters raised in the peer architectural review, and
improve on the development’s presentation to the adjacent streets.
The applicant’s submission regarding waste storage areas, and surveillance of rear podium car
park the applicant’s submission is accepted.
However, while some additional landscaping has been achieved to Pelican Street, it is
considered that additional landscaping should be provided to the corner of Pelican and Doonella
Street as shown on the sketch attached to architectural review. This will mean the loss of a
further 2 additional car parking spaces for the development reducing the total number of spaces
from 125 to 120 car spaces and 4 motor cycle spaces which are equivalent to 1 car space
pursuant to Council’s planning scheme policy.
Overall, the proposed extensions to the RSL club require an additional 36 spaces to be provided
on site and therefore with the provision of this additional landscaping on the corner of Pelican
and Doonella Street, inclusion of landscaping to Pelican Street and inclusion of a lift, the
proposed development would fall short of the minimum required car parking spaces by 1 car
space. While it would be preferred that the development meet the planning scheme’s minimum
car parking requirements, the proposed reduction is minor.
The proposed extensions at their highest points are 10.5m from the natural ground level. This
height exceeds the planning scheme’s probable solution for maximum height for the community
services zone of 8m and for the Business Centre zone of 10m. This additional height is for the
new gaming extension and while exceeds the planning scheme’s probable solution for height and
is 800mm higher than the existing buildings located on the site, the additional height is not
considered visually intrusive to the street, the surrounding spaces or the skyline consistent with
the planning scheme’s specific outcome for building height. Council’s architectural consultant
also advises that the additional height will assist the building’s articulation and supports the
