PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 FEBRUARY 2017

 The change would not result in a substantially different development because the number
     of houses and lots remains unchanged and the proposed changes affect works external to
     the site that are required under permit conditions;
 The change would not require the application to be referred to additional concurrence
     agencies;
 The original application was impact assessable and the proposed changes would not likely
     cause a person to make a properly made submission because the ultimate development
     remains the same; and
 The change would not cause the approval to involve prohibited development.
On this basis, the applicant has followed lawful process in making a request under s369 of the
Act.

Condition 65.1.7
The western half of Pine Street, extending from the intersection of the new internal loop road

Applicants requested change
The applicant requests that the conditions be amended to:
 Exclude the upgrading of Pine Street from lot 69 to the Bagnalls Road bridge as they
     cannot achieve the required horizontal curve radius requirements in accordance with
     Austroads.
 Nominate a design speed of 40km/h as the existing horizontal curve radius does not
     adhere to any design speeds greater than this.
To achieve this, the applicant proposes that the conditions be re-worded as per the following for
the purpose of clarifying the Pine Street design:
Condition 65.1.4
The eastern half of Pine Street, extending from Garnet Street up to the intersection of the new
internal loop road (near lot 74) shall be upgraded to an External Urban Local Road with a
nominated design speed of 40km/hr.
Condition 65.1.5
The western half of Pine Street extending from Garnet Street up to the intersection of the new
internal loop road (near lot 74) shall be upgraded to an External Rural Collector Road with a
nominated design speed of 40km/hr.
Condition 65.1.6

                                                                                  Page 6 of 125
