GENERAL COMMITTEE MEETING AGENDA 14 AUGUST 2017
Recommendation
The EOI assessment panel recommends that Council issue a Community Market Permit to
Cooroy Farmers and Artisans Market Pty Ltd, subject to the following:
Non-exclusive use of the site;
Suitable permit conditions to address the market use;
The permit may be cancelled at Council’s discretion;
Application of a permit fee for use of the site, based on an independent appraisal of the
site’s market lease value (apportioned to the proposed fortnightly market frequency, i.e.
1/14th of annual market lease rate). This is in line with provisions for allowing exclusive use
of community land under local government regulations; and
The Permit holder must progress and obtain a development approval for the market use, as
required under The Noosa Plan, in a timely manner. It is proposed that a Development
Application will be required to be lodged prior to the 5th fortnightly market. Should the
Development Application be refused the Market Permit would be revoked.
Previous Council Consideration
Ordinary Meeting, 16 March 2017, Item 3, Page 8
That Council note the report by the Property Advisor to the Services & Organisation Committee
Meeting dated 7 March 2017 and proceed to an Expression of Interest process for activation of
the Lower Mill site (Lot 5 SP213104) using the Expression of Interest Criteria and Assessment
Criteria as set out in the report.
Finance & Risk
Finance
The costs incurred in the compliance and administration of a new market permit will be
accommodated in Council’s operational budget within the Corporate Services Department. A
permit fee is proposed to reflect the apportioned market lease value of the site (i.e. 1/14th of
appraised market lease value), which is likely to be in the range of $2,000 -$4,000 per annum.
Risk
The EOI process undertaken has addressed a primary risk of Council’s need to comply with
legislative obligations prior to allowing a commercial party exclusive use of community land.
