EXECUTIVE SUMMARY
Not applicable.

RECOMMENDATION
That Council note the report by the Manager Waste and Environmental Health to the General
Committee Meeting dated 14 August 2017 and submit the following Proposed Motion to the Local
Government Association of Queensland for consideration at its 2017 Annual Conference:
“That the LGAQ lobby the State Government to:
A. Oppose the potential repeal Part 2A Section 7 of the Waste Reduction and Recycling
Regulations 2011 dealing with the areas that may be designated by a local government for
the collection of waste which require local government to develop local laws to replace
                         legislation; and
B. Oppose the potential repeal of Part 5A of the Environmental Protection Regulations 2008
dealing with the operational requirements for the collection of waste, which would require
local governments to develop local laws to replace Part 5A of the legislation, when the
current requirements of Part 5A adequately satisfy the requirements of Local Government.”

REPORT
1. Background Information

As previously discussed with Council at the Services and Organisation Committee dated 8
August 2017, the State Government is intending to repeal Part 2A of the Waste Reduction and
Recycling Regulations 2011 that provides:

“Part 2A Designation of areas by local governments for general or green waste collection.
Section 7 - Designation of areas
A local government may— (a) by resolution, designate areas within its local government area in
which the local government may conduct general waste or green waste collection; and (b) decide
the frequency of general waste or green waste collection in the designated areas”.

The State Government also intends to repeal Chapter 5A of the Environmental Protection
Regulations 2008. Chapter 5A deals with waste management by Local Governments and
provides all of the mechanisms for how Local Government handles waste collection, provision of
bins, the obligations for owners and occupiers and the penalties that may be applied for failure to
comply with the legislation. The following list details in summary form, the headings of the various
sections of legislation that are to be repealed, showing the extent of the local laws that would be
required.
